On June 18, 2024, President Biden announced executive actions that will allow certain noncitizen spouses and children of U.S. citizens to obtain work authorization and legal permanent resident (LPR) status and provide eligible Deferred Action for Childhood Arrivals (DACA) recipients and other Dreamers with a path to receive a work visa.

USCIS has now released the filing process to consider requests for eligible noncitizen spouses of U.S. citizens who have been continuously physically present without admission or parole in the United States for 10 years or more; have no disqualifying criminal convictions; do not pose a threat to national security and public safety and pass vetting; are otherwise eligible to apply for adjustment of status; and merit a favorable exercise of discretion.

USCIS will begin accepting applications for the new Keeping Families Together Parole in Place program on Monday, August 19th. Applicants must use a new form, Form I-131F, Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens, which will only be available for electronic filing. This form will not be accessible until August 19th; however, USCIS has published a filing guide on the Keeping Families Together webpage (https://www.uscis.gov/keepingfamiliestogether). Each applicant, including minors, must file a separate Form I-131F, and have their own USCIS online account.
