USCIS has announced last week that premium processing will be available for some fiscal year 2020 H-1B cap petitions, for an additional fee of $1,410 per petition. However, USCIS also announced that it will offer premium processing in a new, two-phased approach for FY-2020 H-1B cap petition filings. In the first phase, USCIS will accept H-1B cap petitions filed concurrently with a request for premium processing if the petition involves a request for a change of status. For H-1B cap petitions requesting a change of status, employers must file the Form I-907 Request for Premium Processing concurrently with the H-1B cap petition (if they would like to request premium processing), and USCIS will begin processing these petitions no later than May 20, 2019. For all other H-1B cap petitions, including those requesting consular notification, USCIS may allow premium processing in June 2019, or later.
Please note that USCIS will accept H-1B cap petitions starting on April 1 until April 5, 2019. At this time, all other H-1B petitions, such as those requesting an extension or amendment of stay, and change of employer petitions, may be filed with premium processing, for an additional $1,410 fee.
