USCIS Extends Employment Authorization Document Automatic Extension Period

Published on April 9, 2024

USCIS announced a temporary final rule that increased the automatic extension period for certain employment authorization documents (EADs) from 180 days to 540 days. This temporary rule applies to eligible applicants who timely filed EAD renewal applications on or after October 27, 2023, that were still pending on April 8, 2024, when this rule took effect. This rule also applies to applicants who timely filed their EAD renewal applications between April 8, 2024, and September 30, 2025.

It is important to keep in mind that this rule does not apply to all EAD categories. Please click here for a chart of eligible EAD categories. For example, F-1 students who have a pending STEM optional practical training (OPT) extension application are not eligible for the temporary increase in the automatic extension period.

USCIS published a similar temporary final rule in 2022, which applied to eligible EAD renewal applications filed between May 4, 2022, and October 26, 2023.
