USCIS announced today that it will resume Premium Processing for all pending fiscal year (FY) 2019 H-1B cap petitions on Monday, January 28, 2019. Employers with pending FY-2019 H-1B cap petitions filed in April 2018 may now request Premium Processing by interfiling a Form I-907, Request for Premium Processing Service, along with payment of $1,410, and an executed Form I-907, Request for Premium Processing Service.
Premium Processing is an optional expedited case adjudication service for certain employment-based visa petitions. Many employers prefer to utilize the Premium Processing service, as petitions filed with Premium Processing are adjudicated by USCIS within 15 calendar days of the receipt of the petition. Premium Processing has been suspended for all non-cap-exempt H-1B petitions, with the exception of H-1B petitions filed by the same employer requesting a continuation of previously approved employment without a change in the position. The temporary suspension of Premium Processing remains in effect for all other categories of H-1B petitions to which it applied, including H-1B petitions requesting a change of employer and amended H-1B petitions. USCIS has previously indicated that it will resume Premium Processing for all remaining H-1B petitions on February 19, 2019.
