The Department of Homeland Security (DHS) has announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months due to the Russian invasion. To qualify, Ukrainian nationals must have continuously resided in the United States as of March 1, 2022. Individuals who travel to the United States after March 1, 2022, are not eligible for the designation. Once TPS is granted, an individual cannot be detained by DHS on the basis of his or her immigration status in the United States. The TPS designation will go into effect on the publication date of the forthcoming Federal Register notice, which is expected to be released in the coming days. The notice in the Federal Register will also provide instructions on applying for TPS and an Employment Authorization Document (EAD).
